| 1. | Incorporation by reference |
| In addition to the General Terms and the Specific Terms and Conditions of SingTel, which terms and conditions are deemed incorporated by reference , the Customer shall be bound by the following Specific Terms and Conditions | |
| 2. | Definitions and Interpretation |
| 2.1 | In these Specific Terms and Conditions, the following words and expressions shall have the following meanings: |
“Content” means all information, data, text, music, sound, photographs, graphics, video, messages or other materials in whatever form transmitted using or available through the Trial Service, "Customer" means any person who applies for or subscribes for or utilises the Trial Service. "General Terms" means Singapore Telecommunications Limited's General Terms and Conditions of Service. “Law” has the meaning set out in the General Terms and, for the avoidance of doubt, includes the Broadcasting (Class Licence) Notification and Broadcasting Act (Cap 28) including all amendments and revisions thereto from time to time in force and all rules and regulations made thereunder and the rules, regulations, codes of practice, guidelines and directions of the Media Development Authority of Singapore made under or pursuant to any law in force in the Republic of Singapore, including the Code of Practice for Market Conduct in the Provision of Mass Media Services "Trial Service" means the service, offers only to Leonie Hills and Gardens@Bishan residents known as SingTel 80Mbps Broadband which is a broadband service offering upload and download speeds of 80Mbps. "SingTel" means Singapore Telecommunications Limited and its successors. |

| 1.2 | The words and expressions used in these Specific Terms and Conditions, which are defined in the General Terms but are not defined in these Specific Terms and Conditions shall have the same meanings as defined in the General Terms unless the context otherwise requires. |
| 1.3 | The headings or titles to the Clauses in these Specific Terms and Conditions are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these Specific Terms and Conditions. |
| 3. | Duration of Service and Termination |
| 3.1 | The Trial Service shall be available on a trial basis for 6 months (July 22, 2006 to January 31, 2007) SingTel reserves its right to terminate the Trial Service at any time. |
| 4. | Fees and Registration |
| 4.1 | Wavier of subscription rates are applicable for the duration of the Trial Period. |
| 4.2 | Should Customer terminate the Trial Service within the Trial Period, $100 will be charged for the cancellation. |
| 4.3 | Customer will be charged $52.50 if the installation date, specified at time of application of the service is missed or does not meet the Minimum System Requirements. |
| 4.4 | The Service is only available at the installation premises specified at the time of application of the service. |
| 4.5 | Trial Service is limited to one application per apartment. |
| 4.6 | All prices are inclusive of 5% GST. |
| 4.7 | The final sign up date is 31 August 2006. |
| 5. | Installation |
| 5.1 | The customer will allow SingTel and its authorised installers to install the Optical Network Terminator (ONT box), battery pack and other equipment in the apartment’s Utility Closet in order to activate the Broadband access. |
| 6. | Disclaimer |
| 6.1 | SingTel Broadband will not be held responsible for: |
| (a) | any connection issues and disruptions arising from the Customer’s computer not being compatible or meeting the Minimum Systems Requirement of the Customer’s modem. |
| (b) | any lost or damage incurred as a result of the installation. |
| 7. | Trial Service Requirements and Limitations |
| 7.1 | The Customer acknowledges and agrees that : |
| (a) | the Customer may receive certain communications from SingTel, such as service announcements, administrative messages and that these communications are considered part of the Trial Service and the Customer will not be able to opt out of receiving them; |
| (b) | any new features introduced from time to time to augment or enhance the Trial Service, shall be subject to these Specific Terms and Conditions; |
| (c) | the Trial Service is provided on an "as is" basis and that SingTel assumes no responsibility for the timeliness, deletion, misdelivery, non-delivery or failure to store any Customer communications or personalization settings or any feature of the same; |
| (d) | the technical processing and transmission of the Trial Service, including the transmission of Content may involve transmissions over various networks; and changes to conform and adapt to technical requirements of connecting networks or devices. |
| 7.2 | The Customer acknowledges and agrees that: |
| (a) | the Customer is responsible for all Content that the Customer emails, transmits or otherwise makes available via the Trial Service; |
| (b) | SingTel does not control the Content posted via the Trial Service and, as such, does not guarantee, and is not responsible for, the accuracy, integrity, legality or quality of such Content; and |
| (c) | SingTel shall not be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, violation or infringement of any proprietary or other rights of another party in the Content, or for any other loss or damage of any kind incurred as a result of the use of any Content emailed, transmitted or otherwise made available via the Trial Service. |
| 7.3 | The Customer agrees not to or not to allow or permit any other person to use the Trial Service to: |
| (a) | violate the rules, regulations and policies (applicable to any mobile operator, service provider, network, server, computer database, web site or newsgroup accessed by the Customer or any end-user; |
| (b) | send, or facilitate the sending of, unsolicited material ("Spam") to any person or system in a way that could be expected to adversely impact any network or facilities; |
| (c) | propagate or knowingly reply to Spam; |
| (d) | collect responses from Spam (whether or not such Spam is sent using the Trial Service); |
| (e) | violate any other person’s rights, or interfere with another person’s use of the Service, including, without limitation, by engaging in activities that result in, encourage or facilitate the distribution of viruses, worms, time bombs, Trojan horses, cancelbots, sniffer, or other code(s) that are designed to acquire information about other users or their activities without their approval, or disrupt the functionality or availability of any computer program, database, the Trial Service supplied to any other Customer, or any Internet host, or engage in any other similar activities in relation to the Service; |
| (f) | infringe the privacy of another person; |
| (g) | publish or communicate material that is obscene, pornographic, inflammatory, harassing, threatening, tortious, abusive, harmful to minors, defamatory, libellous or otherwise objectionable or offensive; |
| (h) | break, or attempt to break, into any computer hardware, software, system or procedure, or to access or attempt to access any computer hardware, software, system or procedure without authorisation; |
| (i) | forge, remove or modify identifying network header information ("spoofing"), or employ any other method that may mislead any person or dishonestly disguise any user name or the source or quantity of transmissions; |
| (j) | use or store any bots on SingTel’s servers; |
| a. | relay material through any third-party systems without authorisation; |
| b. | carry out any other activities which we consider to be actually or potentially injurious to our other Customers, or to SingTel’s operations or reputation; |
| c. | infringe any patent, trademark or copyright or any other intellectual property right of any third party or any SingTel Group Corporation. |
| 7.4 | The Customer agrees to provide feedback on the Trial Service through surveys during and after the Trial Period. |
| 8. | Consent to Use and Disclose Customer Information and Data |
| 8.1 | The Customer agrees that SingTel shall be entitled to use or disclose any information or data disclosed by the Customer in accordance with Clause 15 of the General Terms located at the SingTel website at www.singtel.com (or available by phone or fax request or at any SingTel hello! Shop). The Customer is entitled to withdraw such consent in the procedure as prescribed by SingTel from time to time. |
| 9. | General |
| 9.1 | The Customer shall be bound by and shall fully observe and comply with all the General Terms as well as such other terms and conditions as may be agreed or accepted by the Customer. The rights and protections conferred on SingTel under these Specific Terms and Conditions shall be additional to the rights and protections conferred on SingTel under the General Terms and any other terms and conditions agreed or accepted by the Customer. |
| 9.2 | Any Clause in the General Terms, these Specific Terms and Conditions, or any other terms and conditions as may be agreed or accepted by the Customer, that is invalid, unenforceable or illegal shall be enforced as nearly as possible in accordance with its terms, but shall otherwise be deemed severed and shall not affect the enforceability of any other Clauses, which Clauses shall continue to be valid and enforceable to the fullest extent permitted by law. |
