SingNet Value Added Services - My Album

With SingTel’s My Album, you can now store and share your favourite holiday photos, videos, music and MMS all in one place. You can also store and perform automated backups of your important data so you need not worry about hard disk crashes anymore!


Please read the following user terms and conditions carefully, before using the My Album Service. As SingTel provides the Service, by accessing the Service, the Customer will be deemed to have read, understood and accepted these Terms and Conditions.

1. Definitions and Interpretation
In these terms and conditions, the following expressions shall have the following meanings: -

1.1.1 "Access Medium" means the medium (whether a fixed-line telephone, mobile cellular phone, modem or otherwise, including a computer) stipulated or approved by SingTel by or through which the Customer may utilize the Service;

1.1.2 "Affiliates" means companies working with SingTel to provide the My Album service namely the various content providers and other systems integrators;

1.1.3 "My Album" means the virtual storage service provided by SingTel to the Customer to backup, share, and view their data and various other multimedia content;

1.1.4 "Commencement Date" means the date on which the Service shall be provided to Customer pursuant to SingTel's acceptance of Customer's application for the Service;

1.1.5 "Customer" means any person who applies or subscribes for or utilizes the Service;

1.1.6 "General Terms and Conditions" means SingTel's General Terms and Conditions of Service, which is accessible at URL: http://www.singtel.com as, may be amended from time to time by SingTel;

1.1.7 "ISP" means such Internet Service Provider, which provides Internet access service to the Customer;

1.1.8 "Internet Code of Practice" means the Internet code of practice issued by SBA including all subsequent supplements, revisions or amendments thereto;

1.1.9 "Login User ID" means any number or alphanumeric symbols or characters initially assigned by SingTel to you to be used by you, in relation to the Service;

1.1.10 "Password" means any number or alphanumeric symbols or characters initially assigned by SingTel to you to be used by you, in relation to the Service;

1.1.11 “Portal” means the intranet website developed, created and operated by SingTel or for and on its behalf, which may be accessed only with an appropriate Login User ID and Password issued by SingTel;

1.1.12 "MDA" means the Media Development Authority;

1.1.13 "Service" or the “My Album Service” means the virtual storage service provided by SingTel to the Customer, which allows the Customer to backup, share, and view their data and various other multimedia content;

1.1.14 "Subscription Fee" means such fee as shall be stipulated by SingTel to be payable by the Customer to SingTel for its provision of the Service to the Customer;

1.2 All references to the Customer shall mean to refer to both genders.

1.3 The Customer shall be bound by and shall fully observe and comply with all the General Terms as SingTel as such other terms and conditions as may be agreed or accepted by the Customer. The rights and protections conferred on SingTel under these Specific Terms and Conditions shall be additional to the rights and protections conferred on SingTel under the General Terms and any other terms and conditions agreed or accepted by the Customer. In the event of any inconsistency between the terms of these Specific Terms & Conditions and the General Terms, the former shall prevail.


2. Minimum Requirements
The Customer acknowledges that he has a PC that meets or exceeds the following PC requirements, for optimal viewing

• Pentium III 800MHz Processor
• 64MB RAM (at least 128 MB of RAM for Windows XP)
• 8MB Video RAM
• Windows 98 Second Edition, Windows 2000, Windows Millennium Edition, Windows XP Operating Systems
• Windows Media Player Version 9.0 and above
• Internet Explorer 5.0 and above (Netscape is not supported)
• 16-bit sound card
• A broadband ADSL service

* This service is currently not available to Broadband Customers using Macintosh computers.


3. Provisions of Service
3.1 The Customer is eligible to use the Service offered by SingTel only if he satisfies the following:-

3.1.1 The Customer is a Singaporean or Permanent Resident in Singapore holding a valid NRIC or FIN number.

3.1.2 The Customer agrees to abide by and comply with these Terms and Conditions at all times.

3.1.3 The Customer has provided all information SingTel requires in connection with his registration and all such information, including but not limited to change of address, is accurate and complete; and

3.1.4 The Customer maintains and updates promptly the said information provided so as to ensure its accuracy at all times.

3.2 The Customer agrees that the use of the Service shall be conditional at all times on the Customer complying and observing these Terms and Conditions.


4. Service
4.1 The Service is provided to the Customer on a personal usage basis for the sole purpose of the Customer's own use.

4.2 SingTel may need to amend the Service from time to time (e.g. introducing new applications, modifying the user interface, etc). SingTel will use reasonable endeavors to give the Customer notice of any changes to the Service.

4.3 Subscribers may be provided with storage space according to their subscription plans (or such other amount as SingTel may determine from time to time). Subscribers may purchase more storage space via the Portal. Additional storage will be chargeable in accordance with prevailing rates.


5. Use of the Service
5.1 Storing, distributing, sharing of copyright material is restricted by law without the consent of the copyright owner and nothing in this Agreement permits the Customer to do any such act. The Customer bears the responsibility for all the content stored in the service.

5.2 The Customer must comply with any rules imposed by any third party whose content the Customer stores using the Service and take reasonable steps within his power to prevent unauthorized access to the Service.

5.3 The Customer warrants and undertakes that :

5.3.1 SingTel is not responsible for any Content accessible through use of the Service;

5.3.2 SingTel is not responsible for any damage to the Customer or any person at the Customer's premises arising from:

5.3.2.1 for any unlawful purposes including but not limited to, vice, gambling or other criminal purposes whatsoever, nor for sending to or receiving from any person or other persons or displaying any message or posting which is offensive on moral, religious, communal or political grounds, or is abusive, or of an indecent, obscene or menacing character;

5.3.2.2 for persistently sending messages without reasonable cause or for causing any threat, harassment, annoyance, inconvenience or needless anxiety to any person whatsoever;

5.3.2.3 for any purpose or for transmitting messages that is against the public interest, public order or national harmony or offends against good taste or decency;

5.3.2.4 in breach of any regulations, guidelines, instructions, code of practice and the like in whatsoever form that SingTel may issue from time to time relating to the Service or otherwise;

5.3.2.5 to post or transmit any information which contains a virus, worm, cancelbot, trojan horse, time bomb, or other harmful matters;

5.3.2.6 to copy, upload, post, publish, transmit, reproduce, or distribute in any way or manner whatsoever information, software, or other material, which is protected by copyright or other proprietary right or derivative works with respect thereto without obtaining permission of the copyright owner or rights-holder.

5.4 The Subscriber shall be solely responsible for managing the use of the storage capacity of the Service such that it is within the capacity allocated to him or as may be stipulated by SingTel from time to time.

5.5 The Subscriber agrees to defend, indemnify and hold faultless SingTel and its directors, officers, successors and assigns, from and against any and all liabilities, damages, losses, costs and expenses (including reasonable legal fees) caused by or arising out of the actions of the Subscriber, in connection with this Agreement. The Subscriber further agrees to provide prompt notice to SingTel of any complaints, claims or other actions made, threatened or initiated against the Subscriber in connection with or as a result of the Service under this agreement.

5.6 The Subscriber shall, when required by SingTel, Media Development Authority (MDA) or any other regulatory authorities (Regulator), assist SingTel and the Regulator in any investigation by SingTel and the said Regulator into an alleged violation of any law or licence condition committed by any person or persons whomsoever.


6. Password and Security
6.1 The Customer shall protect the secrecy of his Login User ID and Password at all times and shall ensure that the Login User ID and Password are not revealed or disclosed in any manner whatsoever to any person or persons whomsoever. The Customer shall be fully responsible for all use and liability resulting from access to the Service with his Login User ID and Password. SingTel shall hold the Customer solely responsible for unauthorized transactions under his account.

6.2 The Customer shall inform SingTel if he suspects that his Login User ID and Password has been compromised in any manner and change his Password immediately.


7. Maintenance
7.1 If SingTel identifies a fault in the Service, SingTel shall repair it at our discretion as soon as possible.

7.2 The Customer agrees to notify us of any defect in the operation of our provision of the Service by contacting us. SingTel aims to respond as soon as possible during our normal working hours. Many problems can be corrected remotely without the need to dispatch a technician.

7.3 SingTel may charge the Customer for our reasonable cost and expenses in providing maintenance of Service where the need for such maintenance arises out of:

7.3.1 Misuse, neglect or damage to the Service by the Customer;

7.3.2 Any fault or other problem with the Customer's own property, or other property not forming part of the Service; or

7.3.3 The Customer's failure to reasonably comply with the provisions of this Agreement.


8. Management of Systems & Data
8.1 SingTel reserves the right to manage and control access to any computer or any SingTel system or any computer linked to any SingTel system and any data stored therein, in a manner deemed appropriate by SingTel, and to delete any data (whether belonging to, provided or stored by the Customer or otherwise), notwithstanding that such access and the storage of such data is a requirement or constitutes a part of the Service.

8.2 SingTel may use and shall allow any of its affiliates to use any personal information it obtains directly from the Customer or through the Customer's use of the Service for the purpose of managing the Customer's account, for providing and improving the Service and information about the Service and for related direct marketing purposes.


9. Payment
9.1 Customers shall pay the subscription and additional storage (if applicable) charges of the Service as indicated on the SingTel bill. These charges can be found on the Service website.

9.2 SingTel reserves the right to change the fees and charges at any time without prior notice.

9.3 Charges will be billed to the relevant SingTel telephone line account. If such SingTel telephone line account is suspended or terminated for any reason, SingTel reserves the right to likewise suspend or terminate the Service. All fees and charges in respect of the Service are subject to goods and services tax and do not include Internet access subscription charges and other fees chargeable by your telephone service provider or other third parties.

9.4 Should the Service be terminated before the Minimum Subscription Period, Any and all charges, which has been discounted, waived or reduced by SingTel on the basis that the Customer subscribes or utilises the Service for the Minimum Subscription Period, will be reinstated and imposed by SingTel on the Customer retroactively as from the date of commencement of the Service.


10. Termination
10.1 Termination by SingTel

10.1.1 SingTel reserves the right to terminate the Service or part thereof, with or without cause at any time. SingTel shall not be liable for any damages, losses, cost or expenses howsoever caused by or arising out of termination of Service, to the Customer or to any other individual.

10.2 Termination by the Customer

10.2.1 Subject to Clause 9.4, Customers may terminate the Agreement by giving SingTel at least one (1) calendar month’s prior notice in writing.

10.2.2 The date of notice of termination herein stated shall be the date of receipt thereof by SingTel.

10.3 The Customer acknowledges that once the service is terminated, all data stored by the Customer in relation to the Service will be deleted and the Customer account removed. If the Customer requires the service in future, the Customer will have to subscribe to the service as a new Customer. The subscriber shall not hold SingTel responsible and shall hold SingTel harmless from any claim arising from or in connection with the deletion or removal of such data.

10.4 The Customer acknowledges that any data deleted or removed for any reason will no longer be available for retrieval subsequently. Accordingly, in the event that your subscription to the Service or your Service account is resumed or reinstated after your account has been terminated, any data previously stored under your Service account will no longer be available for retrieval.


11. Indemnity
11.1 The Customer undertakes and agrees to indemnify and hold harmless SingTel at all times against all actions, claims, proceedings, costs, losses and damages whatsoever including but not limited to libel, slander or infringement of copyright or other intellectual property rights or death, bodily injury or property damage which SingTel may sustain, incur or pay, or, as the case may be, which may be brought or established against SingTel by any person whomsoever arising out of or in connection with or by reason of the operation, provision or use of the Service and/or equipment under, by reason of or pursuant to this Agreement.


12. Limitation of Liability
12.1 The Customer acknowledge that the Service is provided on an "AS IS" basis. SingTel, its employees, agents, suppliers, vendors, distributors, parent company, and affiliates (collectively, "Affiliates") make no warranty of any kind, expressed or implied, regarding the quality, accuracy, or validity of the Content provided through the Service, or that Services will be uninterrupted or error free. SingTel expressly excludes any implied warranty of satisfactory quantity or fitness for a particular purpose to the fullest extent possible by law.

12.2 Notwithstanding, anything herein contained, SingTel shall not be liable to the Customer in contract, tort (including any negligence whatsoever) or otherwise in respect of any claim brought by a third party nor shall SingTel be liable to the Customer or any third party whomsoever for any indirect, special or consequential damages including without limitation, loss of business, loss of revenue or loss of profit whether or not SingTel was or should have been aware of the possibility that such damage or loss could occur.


13. Variation
13.1 SingTel reserves the right to amend the terms and conditions herein contained at any time and the Customer shall be bound by the terms and conditions so amended. SingTel may give notice of the amendment to the Customer in such manner, as SingTel deems proper. If the Customer continues to use the Service after such notice, he shall be deemed to have accepted the amendment.


14. Assignment
14.1 The customer shall not assign or delegate or otherwise deal with all or any of his rights and obligations under this Agreement without the prior written consent of SingTel which consent shall not be unreasonably withheld or delayed.

14.2 SingTel shall have the right to assign or otherwise delegate all or any of SingTel 's rights and obligations hereunder to any of its subsidiaries or any other person or entity upon notification to the Customer.


15. Laws Applicable and Jurisdiction
15.1 This Agreement shall be subject to and construed in accordance with the laws of the Republic of Singapore and the Customer and SingTel hereby submit to the exclusive jurisdiction of the Courts of the Republic of Singapore.
