| | 1. Incorporation by reference
In addition to the General Terms and the Specific Terms and Conditions of SingTel Mobile, which terms and conditions are deemed incorporated by reference, the Customer shall be bound by the following Specific Terms and Conditions. 2. Definitions and Interpretation 2.1 In these Specific Terms and Conditions, the following words and expressions shall have the following meanings:
“Customer” means any person who registers or subscribes to the Service. “General Terms” means the Singapore Telecommunications Limited's General Terms and Conditions of Service. “Price Plan” is the subscription plan which the Customer subscribes to. “Service” means SingTel Mobile’s Phone Backup service which allows customers to back-up all their personal data via a SyncML-enabled phone to a server. “Personal Data” means any contact, calendar, task and note stored in the Service. “SingTel Mobile” means Singapore Telecom Mobile Private Limited and its successors. "Service Number" means any number or alphanumeric symbols or characters assigned by any SingTel Group Corporation or selected by the Customer for the purpose of: the provision to or utilisation by the Customer of any Service and/or SingTel Equipment; and/or identifying the Customer (whether to any telecommunications system or facility operated by any SingTel Group Corporation and/or to any other system or facility operated by any other person) for the purpose of or in relation to any Service, including telephone number, mailbox number, e-mail number or address, network user identity, password and circuit reference number
2.2 The words and expressions used in these Specific Terms and Conditions, which are defined in the General Terms but are not defined in these Specific Terms and Conditions shall have the same meanings as defined in the General Terms unless the context otherwise requires.
2.3 The headings or titles to the Clauses in these Specific Terms and Conditions are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these Specific Terms and Conditions. 3. Registration 3.1 The Customer registers for the Service via application at any SingTel hello! Customer Service Centers specified at SingTel website, www.singtel.com or WAP portal, www.ideas.singtel.com. The Service shall commence the next working day. 3.2 A one-time registration fee of $10.70 (incl. GST) will be charged for each successful registration. 4. Fees and Charges 4.1 Monthly subscription fee for the Service is $2.14 (incl. GST). 4.2 Prevailing GPRS traffic charges apply 4.3 A minimum subscription period of 1 month applies. 4.4 The Customer is eligible to subscribe to 1 Service per Service Number. 5. Termination
5.1 The Customer may request to terminate the Service at any SingTel hello! Customer Service Centers specified at SingTel website, www.singtel.com or by calling SingTel Mobile Customer Service Hotline, 1626. The termination will take effect by the next working day.
5.2 Upon termination of the Mobile Line, the Service will be automatically terminated.
6. Service Requirements and Limitations
The Customer acknowledges and agrees that:
A. The Service is available to SingTel Mobile GSM900 2G & 3G post-paid mobile subscribers only.
B. Data Price Plan subscribers are not eligible to sign up for the Service.
C. The Service is supported only by selected phone models. Please check at www.singtel.com for more details.
D. The Service allows you to back up all* your Personal Data via a SyncML-enabled phone to a server. (*Note: Calendar options on Nokia Symbian phones may not be fully supported)
E. The Service is for private and personal use only and is therefore not to be used for commercial gain
F. The Customer is responsible for the Personal Data that he stores or synchronises using the Service.
G. As the Service provided is for your private and personal use, SingTel Mobile does not monitor the use of the Service or any Personal Data therein under normal circumstances. Neither does SingTel Mobile exercise editorial control over the Personal Data stored using the Service. As such, SingTel Mobile assumes no responsibility for the Personal Data stored using the Service.
H. Any new features introduced from time to time to augment or enhance the Service shall be subject to these Terms and Conditions.
I. The Customer may receive certain communications from SingTel Mobile, such as administrative messages and that these communications are considered part of the Service.
J. SingTel Mobile does not control the content of the Personal Data that the User stores using the Service and, as such, does not guarantee, and is not responsible for, the accuracy, integrity, legality or quality of such content.
K. SingTel Mobile may, in its sole discretion and without prior notice, terminate the User’s access to the Service if SingTel Mobile is of the opinion that the Customer has breached any of these Terms and Conditions or has abused the Service.
L. The Customer shall fully indemnify and hold harmless SingTel Mobile at all times against all actions, claims, proceedings, costs (including legal costs incurred by SingTel Mobile in defending any such actions, claims or proceedings), liability, losses and damages whatsoever which may be brought or commenced against SingTel Mobile by any person and/or which SingTel Mobile may sustain, incur or suffer, as the case may be, directly or indirectly arising out of or in connection with the use of the Service; and
M. SingTel Mobile shall not be liable to the Customer for any loss of damage of any kind incurred as a result of the use of the Service.
N. SingTel Mobile reserves the right to amend these Specific Terms & Conditions without prior notice.
7. Consent to Use and Disclose Customer Information and Data 7.1 The Customer agrees that SingTel Mobile shall be entitled to use or disclose any information or data disclosed by the Customer in accordance with Clause 15 of the General Terms located at the SingTel website at www.singtel.com (or available from SingTel Mobile on written request ). The Customer is entitled to withdraw such consent in the procedure as prescribed by SingTel Mobile from time to time. 7.2 The Customer further acknowledges and agrees that SingTel Mobile may access, preserve, monitor, use and disclose any information relating to the use of Service by the Customer as reasonably necessary to provide, maintain and improve the Service, and to respond to requests for customer service. 8. General
8.1 The Customer shall be bound by and shall fully observe and comply with all the General Terms as well as such other terms and conditions as may be agreed or accepted by the Customer. The rights and protections conferred on SingTel Mobile under these Specific Terms and Conditions shall be additional to the rights and protections conferred on SingTel Mobile under the General Terms and any other terms and conditions agreed or accepted by the Customer. 8.2 Any Clause in the General Terms, these Specific Terms and Conditions, or any other terms and conditions as may be agreed or accepted by the Customer, that is invalid, unenforceable or illegal shall be enforced as nearly as possible in accordance with its terms, but shall otherwise be deemed severed and shall not affect the enforceability of any other Clauses, which Clauses shall continue to be valid and enforceable to the fullest extent permitted by law. |
