SPECIFIC TERMS & CONDITIONS FOR WIMAX TRIAL OFFERED BY SINGAPORE TELECOM MOBILE PTE LTD ("SINGTEL MOBILE") |
| The WiMax Trial ("Trial") is offered upon the following Specific Terms and Conditions:- |
| 1. | The Trial is made available only to existing SingTel Mobile customers who have subscribed to SingTel Mobile Data Plan(s)1 with SingTel Mobile. |
|
| 2. | Eligible customers will be selected by SingTel Mobile ("Participants") for participation in the Trial. SingTel Mobile has the sole discretion to select the Participants. |
|
| 3. | All Participants must agree to these Specific Terms and Conditions. |
|
| 4. | Participants are required to purchase the WiMax PCMCIA data card ("WiMax Card") at a price of Singapore Dollars Eight Hundred and Fifty-six (S$856.00, inclusive of 7% GST, non refundable) or whatever prevailing price determined by SingTel Mobile from time to time. |
|
| 5. | Participants will be entitled to a free Trial during the trial period commencing on 22 December 2006 and ending on 31 December 2007 ("Trial Period"). For the avoidance of any doubt, access charges will not apply during the Trial Period. |
|
| 6. | Participants will be allowed to test wireless internet surfing6 in the 2.5 GHz frequency band using Pre-WiMax 802.16e. ("WiMax Broadband"). |
|
| 7. | From time to time during the course of the Trial Period, Participants will be requested to provide feedback on the Trial, the WiMax Card and/or the WiMax Broadband. |
|
| 8. | SingTel Mobile does not guarantee during and after the expiry of the Trial Period:-
(i) the continued availability of WiMax Broadband as a commercial service;
(ii) the quality, fitness for purpose, reliability and/or suitability of WiMax Broadband;
(iii) the compatibility/interoperability of the WiMax Card with the WiMax Broadband and/or the Participants' computer/laptop/equipment. |

| 9. | Participants acknowledge that participation in the Trial is at the Participants’ sole risk and responsibility. SingTel Mobile shall not be liable to Participants in any manner, whether in contract, tort or otherwise for any failure, interruption, breakdown, incompatibility or any other claims, losses, damages, expenses or costs whatsoever incurred by Participants by reason of or in connection with participation in the Trial. |

| 10. | Outdoor coverage for WiMax Broadband during the Trial Period would be limited to the following locations only:
(i) SingTel Comcentre, 31B Exeter Road (S) 239733
(ii) Shaw Centre, 1 Scotts Road (S) 228208. |

| 11. | Due to the nature of wireless broadband access, there is an inherent risk of wrongful, illegal or unauthorized access by third parties to Participants’ computer(s) and/or account(s). Participants hereby acknowledge and accept the risk of such wrongful, illegal or unauthorized access and hereby agree that SingTel Mobile shall not be liable for any loss or damage arising from such activities in general. |

| 12. | The Participants shall protect the secrecy of their respective login User IDs and Passwords at all times. SingTel Mobile shall hold the Participants solely responsible for all unauthorized or illegal transactions or activities carried out under the Participants' account. |
|
| 13. | The Participants agree not to do any acts in violation of any laws or regulations applicable from time to time or to misuse the Trial in any manner deemed inappropriate by SingTel Mobile. |
|
| 14. | The Participants acknowledge that these Specific Terms and Conditions are in addition to the following terms and conditions:-
(i) SingTel's General Terms and Conditions of Service;
(ii) SingTel's Billing Terms and Conditions;
(iii) Specific Terms and Conditions of SingTel Mobile;
(iv) Specific Terms and Conditions of Service - SingNet,
which terms and conditions are binding on Participants and deemed incorporated by reference into these Specific Terms and Conditions.

2 Access charges refer to traffic charges and do not include charges associated with premium content download.
