SingTel Specific Terms & Conditions for LIVECam Service

 1.  Incorporation by Reference
  In addition to the General Terms and Specific Terms and Conditions of SingTel (which Terms and Conditions are deemed incorporated by reference), the Customer shall be bound by the following Specific Terms and Conditions of SingTel's LIVECam Service.
  
 2.  Definition and Interpretation
  2.1  In these Specific Terms and Conditions, the following words and expressions shall have the following meanings:
  a. "Video services" means the SingTel Mobile 3G Mobile Service, SingTel Video Call Service &/or SingTel Video Call on Broadband Service
  b. Camera" means the camera(s) approved by SingTel for use with the Service, including all peripherals supplied within the camera package.
  c. "General Terms" means Singapore Telecommunications Limited's General Terms and Conditions of Service.
  d. "Property" means the premises owned and/or occupied by the Customer or where the Customer is not the owner, the premises on which the Customer is authorized or permitted to use the Service and install the camera.
  e. "Service" means the service known as LIVECam which allows Customers to access their camera(s) to view the Service Environment(s) remotely via one or more of the Video services.
  f. "Service Environment" means the location in the Property where the camera(s) is/are installed.
  g. "Working Days" means Mondays to Fridays excluding gazetted public holidays in Singapore.
  h. "Installer" means the Third Party Installer who will provide configuration and installation services for the LIVECam Service.
  i. "Monthly Charge" is the sum of the cost of the Camera & Basic Configuration Package divided by the contractual period of 24 months
    
 2.2  The words and expressions used in these Specific Terms and Conditions, which are defined in the General Terms or the Specific Terms and Conditions for SingTel but not defined in these Specific Terms and Conditions shall have the same meanings as defined in the General Terms for SingTel unless the context otherwise requires.
    
 2.3  The headings or titles to the Clauses in these Specific Terms and Conditions are to facilitate reference and shall not be referred to or relied upon in the construction of any provision of these Specific Terms and Conditions.
  
 3.  Target Market
  3.1  The Service is available for both Residential & Business customers.
   
4.  Authorisation Use of Service
  4.1  If the SingNet Broadband Service / SingNet Business ADSL is not registered under the Customer's name, the Customer shall warrant to SingTel that they have obtained proper authorization from the registered customer of the SingNet Broadband Service / SingNet Business ADSL to activate LIVECam Service. If the consent by the registered customer of the SingNet Broadband Service / SingNet Business ADSL is withdrawn of any reason whatsoever, SingTel shall terminate the LIVECam Service & Customer has to pay all charges incurred including Early Termination Charge of the Service and/or Camera & Basic Configuration Package.
   
5.  Minimum Requirements
 5.1  To use the Service, the following are required:
  a. the Camera, which the Customer is required to purchase from SingTel appointed retailer(s) at the prevailing retail price;
  b. SingNet Broadband Access Service (Residential) <"SingNet BroadBand Service"> or SingNet Business ADSL Access Service (Business) <"SingNet Business ADSL"> - Unlimited ADSL connection of at least 256k uplink, subscribed by the Customer or where the Customer is not the subscriber, he/she is authorised or permitted to use the said connection for the Service.
  c. one of the following SingTel Approved routers:
   
•2Wire 2700HG •2Wire 1800HW •2Wire 1800HG •Thomson ST585 •Thomson ST570 (1 Ethernet Port only)
•Aztech 600EW & 600EU (For SingNet Business ADSL)
    
  d. At least one of the below SingTel Video services for service access:
   
•3G Mobile•Video Call •Video Call on Broadband
  
 6.  Commencement and Minimum Subscription Period of Service
  6.1  The Service shall be activated within three (3) Working Days as stated in the Service Request Cum Agreement Form for existing SingNet BroadBand / SingNet Business ADSL Customer, provided that the minimum requirements stipulated in Clause 5 are fulfilled. For new SingNet BroadBand / SingNet Business ADSL customer, the Service will be activated within four (4) Working Days. However, subject to telephone line condition and location, it may take about one month or longer for the Service to be activated.
 6.2  The Minimum Subscription Period for the Service shall be :
  a. a period of three (3) months from the commencement date of the Service; or
  b. such other period as may be stipulated by SingTel as the Minimum Subscription Period before or when the Customer applies for the service. Thereafter, the Service shall continue in force until terminated by SingTel or the Customer.
 6.3  The Contractual Period for the Camera and Basic Configuration Package is 24 months.
  
 7.  Termination
  7.1  The Early Termination Charge ("ETC") on the Camera & Basic Configuration Package applies if the Service is terminated within the Contractual Period. ETC is calculated based on the remaining Contractual Period multiply by the Monthly Charge.
 7.2  The Service shall automatically terminate on termination for any reason of the Customer's SingTel Telephone Service.
 7.3  Where the Customer terminates the Service, the Customer shall be liable for the Fees and Charges for the Service till the end of the said calendar month in which the termination occurs.
 7.4  Where the Customer terminates the Service, this shall not constitute a termination request for the SingTel Telephone Service and the Customer shall still be liable for the SingTel Telephone Service Fees and Charges.
 7.5  The termination of SingNet Broadband Service or SingNet Business ADSL does not constitute the termination of the Service. Customer is required to terminate the Service separately. However, until such Service is terminated by Customer, Customer shall be liable for the Fee and Charges pertaining to the Service. For avoidance of doubt, SingNet BroadBand Service or SingNet Business ADSL is a pre-requisite for the provision of the Service.
 7.6  Without prejudice to anything in the General Terms and Specific Terms and Conditions for SingTel, SingTel reserves the right to suspend, restrict, or terminate the Customer's access to the Service for any reason whatsoever. No notice will be required to be given of such action and SingTel shall not be liable in damages or otherwise for such suspension, restriction or termination.
   
  
8.  Service Requirements and Limitations
 8.1  The Customer agrees not to use and not to allow or permit any other person to use the Service to:
  a. cause any threat, harassment, distress, annoyance, inconvenience or anxiety to any person whomsoever;
  b. violate any other persons rights, infringe the privacy of another person, or interfere with another persons use of the Service;
  c. carry out any activities which are actually or potentially injurious to other Customers or persons, or to the operations or reputation of any SingTel Group Company;
 8.2  Customer will be responsible for all use of the Service subscribed by Customer, including use by any end-user, whether or not that use is with your knowledge or consent.
 8.3  Customer agrees that Customer and each end-user will use the Service in an ethical, appropriate and responsible manner.
 8.4  The Customer acknowledges and agrees that :
  a. the Customer is required to sign the LIVECam Service - Configuration and Installation Agreement between Subscriber and Third Party Installer during point of sign-up.
  b. the Service includes Basic Configuration Package whereby the charges is either paid upfront during point of sign-up or via SingTel Bill for a period of 24 months.
  c. the Service excludes any supplementary services and miscellaneous services eg mounting of brackets and/or camera(s), wiring of electrical power point. However, Customer may request for the supplementary services at the point of installation. The supplementary services' charge(s) will be paid by the Customer directly to the Third Party Installer. The charges for the miscellaneous service will be paid by Customer directly to the Third Party Installer.
  d. the Third Party Installer is fully responsible for the successful configuration and installation of the Service;
  e. there will be no refund or change of Camera(s) after the Camera(s) is/are purchased.
  f. the Customer is only permitted to use the Service and the Camera within the Service Environment;
  g. Customer may receive certain communications from SingTel, such as service announcements, administrative messages and that these communications are considered part of the Service.
  h. any new features introduced from time to time to augment or enhance the Service, shall be subject to these Specific Terms and Conditions;
  i. the Customer is responsible for obtaining access to the Service and providing all materials like wiring, power point or whatsoever including but NOT limited to the requirement under Clause 5 which is necessary to access the Service; and
  j. the Service is provided on an "as is" and "as available" basis
  k. the use of the Service may affect the surfing speed of the SingNet BroadBand Service or SingNet Business ADSL connection used in the connection with the Service.
  l. LIVECam service and installation is only available on the mainland of Singapore.
  m. the Service is non-transferable.
  
9.  Disclaimers
 9.1  SingTel does not warrant the Service will be provided uninterrupted or free from errors or that any identified defect will be corrected; further, no such warranty is given that the Service is free from any virus or other malicious, destructive or corrupting code, program or macro.
 9.2  The Customer further acknowledges and agrees that SingTel :
  a. expressly excludes any guarantee, representation, warranty, condition, term, or undertaking of any kind, express or implied, statutory or otherwise or any representations or warranties arising from usage or custom or trade or by operation of law, including (without limitation) as to the sequence, originality, correctness, completeness, accuracy, timeliness, completeness, currency, non-infringement, merchantability, or fitness for any particular purpose;
  b. shall in no event be liable to the Customer in respect of any matter arising out of or in connection with the Service in contract or tort or otherwise for any loss (whether direct or indirect) of profit, business, revenue, anticipated savings, goodwill or any loss or corruption of data, or any indirect, special or consequential loss or damage whatsoever;
  c. shall not be responsible for the consequences of the use of the Service and SingTel hereby excludes all liability of any kind whatsoever or howsoever caused, whether arising under contract, tort (including but not limited to negligence) or otherwise in connection with or arising from:
  
i.
ii.
the use of the Service by the Customer; or
any inaccuracies, errors, omissions or mistakes in, or any delays or interruptions, linked to or referable to the Service;
  d. shall not be liable to the Customer for any loss and/or damage or whatsoever in respect of any matter arising from any act and/or omission of the Third Party Installer;
  e. to the fullest extent permitted by law, shall not be liable to the Customer for any liability, damages, losses, costs or expense incurred by the Customer as a result of or arising from or in connection with, any electronic, electrical, mechanical or other failure, error, breakdown, malfunction, omission, interruption or delay, whether of any computer system, terminal communication lines, equipment or otherwise howsoever caused notwithstanding that it is advised of the possibility of such liability, damages, losses, costs and/or expenses.
   
10.  Consent to Use and Disclose Customer Information and Data
 10.1  The Customer agrees that SingTel shall be entitled to use or disclose any information or data disclosed by the Customer in accordance with Clause 15 of the General Terms located at the SingTel website at www.singtel.com (or available from SingTel on written request). The Customer is entitled to withdraw such consent in the procedure as prescribed by SingTel from time to time.
 10.2  The Customer further acknowledges and agrees that SingTel may access, preserve, monitor, use and disclose any information relating to the use of Service by the Customer as reasonably necessary to provide, maintain and improve the Service, and to respond to requests for customer service.
   
11.  General
 11.1  The Customer shall be bound by and shall fully observe and comply with all the General Terms as well as such other Terms and Conditions as may be agreed or accepted by the Customer. The rights and protections conferred on SingTel under these Specific Terms and Conditions shall be additional to the rights and protections conferred on SingTel under the General Terms and any other Terms and Conditions agreed or accepted by the Customer.
 11.2  Any Clause in the General Terms, these Specific Terms and Conditions, or any other Terms and Conditions as may be agreed or accepted by the Customer, that is invalid, unenforceable or illegal shall be enforced as nearly as possible in accordance with its terms, but shall otherwise be deemed severed and shall not affect the enforceability to the fullest extent permitted by law.
 11.3  SingTel reserves the right to alter, modify, add to or otherwise vary these Specific Terms and Conditions.

SingTel Mobile Specific Terms & Conditions for LIVECam Service

  d. d. do any act that may at any time be prohibited by SingTel Mobile's Acceptable Use Policy which can be found at URL www.singtel.com
For the avoidance of doubt, the SingTel Mobile Acceptable Use Policy shall be deemed incorporated into these Specific Terms and Conditions for SingTel Mobile by reference and shall be in addition thereto. Where the Customer breaches any obligation under this Clause 8.1, SingTel Mobile may suspend the Service until the breach is remedied to the satisfaction of SingTel Mobile without any prejudice to any other right or remedy it may then have.
 8.2  The Customer acknowledges and agrees that :
  a. the Customer is required to sign the LIVECam Service - Configuration and Installation Agreement between Subscriber and Third Party Installer during point of sign-up.
